比荷卢商标申请注册的流程简介
比荷卢商标注册申请的受理部门为比荷卢联盟商标局。比荷卢联盟商标局设在海牙，没有统一的商标注册簿，效力覆盖比荷卢联盟所属3个国家。只要商标申请人依法交纳商标申请费，比、荷、卢三国各商标注册局也可以受理商标申请。受理商标申请的机关应确保申请文件符合商标法规的要求。审核商标申请文件后，商标受理机关认为商标申请符合法律规定的，应该出具申请受理书并注明商标正式申请日。商标申请人向比荷卢联盟商标局或各国家商标局提交一份商标注册申请，即可在比荷卢联盟3个国家获得商标注册保护，但就比荷卢联盟各部分地区提交商标注册申请将不予受理。
(一)提交商标申请所需文件
1.法律规定格式的申请书4份，应列明以下内容：商标描述;打算注册的商品和服务清单;申请人名义、地址;如需指定颜色的，需进行颜色申明(描述不得超过50个字);申请人或代表人签字。服务商标申请，则需要进行权利申明，商标最早使用日期;立体商标或集体商标申清必须在申请书中明确表示。文字商标必须用黑体宇表示。
2.委托书文件，签字即可，无须办理公认证手续。
3.5份黑白商标图样(文字商标无须提供商标图样)，规格：尺寸不得小于1.5cmXl.5cm，不得大于8cmX8cm(其中4份粘贴在申请书上)。如果为色彩商标，除提交15份黑白墨稿以外，还应提供20份颜色商标图样，尺寸不得小于1.5cmXl.5cm，不得大于2lcmX29.7cm。
4.申请前查询单：提交商标注册申请前，商标申请人必须对是否存在在先相同、近似商标进行查询。如果已经办理过商标查询，则应提供3个月内比荷卢联盟商标局出具的查询证明。
5.商标申请付费证明。
6.集体商标申请应提供商标使用和监督规则，一式4份。
7.按照《保护工业产权巴黎公约》规定申请优先权的，申请人应提供基础申请的商标名称、基础国名称、申请日期、申请号码;如果由商标受让人申请优先权的，则应在申请的同时提供商标转让证明。优先权申请可以连同申请一起提交，也可以以特别声明的方式在商标申请后一个月内提交。否则优先权申请视为未提交。
8.根据马德里协定书而提交的国际注册申请，申请文件应制成一式4份，用荷兰文提供的商品清单还必须附带法语译文。
商标申请文件必须为法语或荷兰语，但提交优先权的文件、更名证明，转让文件、许可使用文件以及相关声明书，商标使用和监督规则，或商品修正申请文件等，只要有法语或荷兰语任一语言的译文商标局均可受理。所有提交的文件必须统一使用A4(2lcm X29.7cm)规格纸。
(二)商标注册审查
商标专用权通过注册获得。商标所有权属于在先商标申请人。商标注册可以通过三种途径获得：
1.通过向比荷卢联盟商标局提交商标申请获得;
2.通过向比荷卢联盟任一国家商标局提交商标申请获得;
3.通过马德里商标国际注册申请领土延伸至比荷卢联盟获得。
商标注册申请提交后，商标局要求提供申请前查询证明或要求办理商标申请前查询。在收到商标查询结果以后，商标申请人在4个月内可以决定是否继续商标申请或修改、撤回商标申请。商标申请人必须自查询报告
发出之日起4个月内对是否继续进行商标申请进行确认，否则，比荷卢商标局将商标申请退回申请人。在先冲突商标查询结果不会直接导致商标申请的驳回。
所有基于马德里国际注册而申请领土延伸到比荷卢联盟的商标申请均需自动接受在先冲突商标的查询。
回复官方审查意见的期限为两个月，可申请延期一次，期限为两个月。
(三)商标公告和注册
商标申请经审查通过核准注册后在比荷卢联盟商标公告上公告。公告包括注册商标详细情况，商标修改、变更及续展详细情况等。 商标注册后，商标所有人在比荷卢联盟各国境内享有对其注册商标的专用权。

The acceptance department of the application for trademark registration in BiHollu is the BiHollu Union Trademark Office. The Trademark Office of the BiHollu Union is located in The Hague, without a unified trademark registration book, and serves the three countries of the BiHollu Union. As long as the trademark applicants pay the trademark application fee according to law, the trademark registration bureaus of the three countries, Bi, Netherlands and Lu, can also accept the trademark application. The authority accepting trademark application should ensure that the application documents meet the requirements of trademark regulations. After reviewing the trademark application documents, if the trademark acceptance authority thinks that the trademark application conforms to the law, it should issue the application acceptance letter and indicate the official application date of the trademark. A trademark applicant submits a trademark registration application to the Trademark Office of the BHP or the National Trademark Office, which can obtain trademark registration protection in three countries of the BHP, but the application for trademark registration in various parts of the BHP will not be accepted.
( 1 ) Documents required to submit a trademark application
1. Four applications in the form prescribed by law shall include the following : description of the trademark ; list of goods and services to be registered ; name and address of the applicant ; if you need to specify a color, you need to make a color declaration ( description shall not exceed 50 words ) ; signature by the applicant or representative. Service trademark application, the need for rights declaration, trademark earliest use date ; stereoscopic trademarks or collective trademarks must be clearly stated in the application. The text trademark must be expressed in bold.
2. Appointment documents shall be signed without official certification.
3.5 black and white trademark drawings ( text trademarks do not need to provide trademark drawings ), specifications : size shall not be less than 1.5 cmX1.5 cm, shall not be greater than 8 cmX8 cm ( 4 of which are affixed to the application ). If it is a color trademark, in addition to the submission of 15 black and white ink manuscripts, 20 color trademark drawings should also be provided, and the size should not be less than 1.5 cmX more than 2l cmX29.7 cm.
4.Pre-application inquiry list : Before submitting a trademark registration application, the trademark applicant must query whether there is the same or similar trademark. If the trademark inquiry has been processed, the inquiry certificate issued by the Trademark Office of the Union of Belgium within 3 months should be provided.
5. Trademark application for payment certificate.
6.The collective trademark application should provide trademark use and supervision rules, in four copies.
7. If an application for priority is made in accordance with the Paris Convention for the Protection of Industrial Property, the applicant shall provide the name of the trademark, the name of the country of origin, the date of application and the application number of the underlying application ; if the trademark assignee applies for priority, the trademark transfer certificate shall be provided at the same time as the application. The application for priority can be submitted together with the application, or can be submitted within one month after the trademark application by special declaration. Otherwise, the application for priority is considered not submitted.
8. An application for international registration under the Madrid Agreement shall be made in four copies in one form and a list of commodities in Dutch must be accompanied by a French translation.
The trademark application documents must be French or Dutch, but the documents that submit the priority, the certificate of renaming, the transfer documents, the license documents and the related declarations, the rules of trademark use and supervision, or the application documents for commodity amendment can be accepted by the Trademark Office of Translation in any French or Dutch language. All submissions must be made with A4 ( 2lcm X29.7cm ) specification paper.
( 2 ) Trademark registration review
The trademark exclusive right is obtained through registration. Trademark ownership belongs to the prior trademark applicant. Trademark registration can be obtained through three ways :
1.By submitting trademark application to the BHP Trademark Office ;
2.By submitting a trademark application to any of the National Trademark Office of the BHP ;
3.Through the Madrid trademark international registration application territory extends to the Union of Bihelu obtained.
After the application for trademark registration is submitted, the Trademark Office requests to provide a certificate of inquiry before the application or to ask for a trademark inquiry before the application. After receiving the results of the trademark inquiry, the trademark applicant may within 4 months decide whether to continue the trademark application or modify or withdraw the trademark application. Trademark applicants must consult their own reports
The application for trademark shall be confirmed within four months from the date of issue. Otherwise, the BiHollu Trademark Office shall return the trademark application to the applicant. The results of trademark query in the first conflict will not directly lead to the rejection of trademark application.
All trademark applications based on Madrid international registration for territorial extension to the BHP need to automatically accept the prior conflict trademark query.
The time limit for replying to the official review is two months, and an extension of one time can be applied for, which is two months.
( 3 ) Trademark announcement and registration
After the trademark application was examined and approved for registration, it was announced in the trademark announcement of the Union of Bengal. The announcement includes the details of the registered trademark, trademark modification, change and continuation details. After the trademark registration, the trademark owner enjoys the exclusive right to the registered trademark in the countries of the BHP.
