如何办理埃及商标注册？

埃及现行商标法规主要基于2002年6月3日颁布的《知识产权保护法》。“埃及贸工部商标和工业设计司”统一负责管理商标事务，官方语言为阿拉伯语。埃及商标注册不是强制性的，但为了保护商标，就必须依法登记注册。埃及商标注册采用“申请在先”原则。

埃及是《商标法条约》、《巴黎公约》、《尼斯协定》、《WIPO公约》和《内罗毕条约》等国际知识产权条约的缔约国；同时也是《商标国际注册马德里协定》的成员国，故埃及商标注册既可以通过“单一国家注册”的方式，也能通过“马德里国际注册”的方式办理。

一、埃及商标注册所需材料

1.商标图样；

2.具体类别及商品/服务项目；

3.申请人名义及地址；

4.委托书使馆认证；

5.若声明优先权的，需提供优先权证明文件并公证认证。

二、埃及商标注册流程

埃及商标注册的主要流程为：申请一受理一审查一公告一核准一发证。

申请递交后2周受理。审查员将对申请进行形式审查和实质审查。形式审查主要审查申请要求和分类信息是否符合规定；实质审查包括对商标显著性、是否违反禁注禁用条款和是否与在先商标形成冲突的审查。审查不能通过的将会下发驳回通知书并要求申请人在驳回通知书载明的时限内予以答复，实质审查通过的，将会被安排公告。自公告日起60天为异议期，任何利益相关人或在先权利人均可提出异议，提异议的理由主要有：

1.与在先商标冲突，如拥有在先的注册商标；

2.商标缺乏显著性；

3.商标具有不良影响；

4.恶意注册；

5.与在先其他权利冲突，如商号权、外观设计、版权、人名等。

公告期内无人异议或者异议不成立的，可获准注册并颁发注册证。

三、埃及商标注册条件

目前，埃及商标申请采用尼斯分类第10版的商品和服务描述，接受一表多类申请。可注册为埃及商标的要素有文字、名称、图形、三维标识、颜色组合、标语等。若申请人不在埃及居住，须委托专门的代理机构办理。

Egypt 's current trademark legislation is based mainly on the ' Intellectual Property Protection Act ' promulgated on 3 June 2002. The Trademark and Industrial Design Division of the Ministry of Trade and Industry of Egypt is responsible for the unified management of trademark affairs, and the official language is Arabic. Egyptian trademark registration is not mandatory, but in order to protect the trademark, it must be registered according to law. Egyptian trademark registration adopts the ' application first ' principle.

Egypt is a party to international intellectual property treaties such as ' Trademark Law Treaty ', ' Paris Convention ', ' Nice Agreement ', ' WIPO Convention ' and ' Nairobi Treaty ' ; it is also a member of the Madrid Agreement on International Registration of Trademarks, so Egyptian trademark registration can be done either by ' single country registration ' or by ' Madrid international registration '.

3. Name and address of the applicant ;

4.Embassy accreditation ;

5.       If the declaration of priority, it is necessary to provide priority certification documents and notarization certification.

If no objection or objection is not established during the announcement period, the registration may be approved and the registration certificate may be issued.
